Floridians Against Inequities in Rates (FAIR), led by former Senate President John McKay, has collected the 61,109 signatures required for Florida Supreme Court review.
While 611,009 voter signatures are required for placement on the ballot in a general election, only ten percent of these signatures allows for review by the Florida Supreme Court. During this review, the Court will determine whether the proposed amendments deal with a single-subject of law and if the ballot summary and title are accurate.
Two previous efforts to repeal Florida’s sales-tax exemptions and exclusions in 2004 and 2006 were removed from the ballots because the ballot summaries were flawed. The Court determined the 2004 proposal violated the single subject rule.
The three new proposed constitutional amendments would
-
repeal most existing sales and use tax exemptions unless affirmatively re-enacted by the legislature;
-
impose a new tax on services that could be overcome by passage of legislation; and
-
make it tougher to enact future legislation granting or renewing sales-tax exemptions.
